How long do I have to file a claim?Different types of personal injury cases can have different statutes of limitations. As a general matter, you have two years from the date of the injury to commence suit; however, you should consult with an attorney as soon as possible after the injury to identify the statute of limitations that applies in your case.
If I file a claim, how long will my case take?That depends. If your case is susceptible to settlement, a recovery may come relatively quickly. If the defendant or their insurer does not want to settle, the case will have to proceed to trial. A case that involves a trial will take longer. Finally, it is not unusual for personal injury cases that are scheduled for trial to settle immediately before trial.
What will it cost?The short answer is nothing. Your attorney typically will not receive a fee until and unless there is a recovery, at which point the lawyer will receive a percentage of what was paid. Your attorney will review any fee arrangement with you when you retain them.
